ELIGIBILITY: The “xBloom 2-year Anniversary Sweepstakes” (“Sweepstakes”) is open only to legal residents of the 50 United States or the District of Columbia (“Territory”) who are at least eighteen (18) years of age or older at the time of entry (or age of majority in their jurisdiction of residence, whichever is older). Any individuals (including but not limited to employees, consultants, independent contractors, and interns) who have, within the past six (6) months, performed services for Sponsor, Administrator, any organizations responsible for sponsoring, fulfilling, administering, advertising or promoting the Sweepstakes and/or their respective parent, subsidiary, affiliated and successor companies (collectively, “Sweepstakes Entities”), and immediate family and household members of such individuals, are not eligible to enter. 

• Immediate family members shall mean parents, step-parents, children, step-children, siblings, step-siblings, or spouses, regardless of where they live. 
• Household members shall mean people who share the same residence at least three (3) months a year, whether related or not. Void where prohibited or restricted by law. 

SWEEPSTAKES ENTRY: The sweepstakes begins at 12:00 PM Eastern Time (“ET”), September 1, 2023 and ends at 11:59 PM ET, September 10, 2023 (“Entry Period”). For purposes of these Official Rules, all times and days are Eastern Time. Administrator’s computer is the official clock for all matters related to this Sweepstakes. You must have an email account to enter. During the Entry Period, visit https://xbloom.com/ (“Website”) and click the “Enter” button. You will need to log in using your xBloom account (the “Account”) user name or e-mail address and password; or, if you do not have an online xBloom account, you will need to create an account. You may create an Account for free by visiting the Website, clicking on the “create account” link and providing the requested information on the registration form. 

CLICK THE CHECKBOX SIGNIFYING THAT YOU MEET THE SWEEPSTAKES ELIGIBILITY REQUIREMENTS, HAVE READ AND AGREE TO THESE OFFICIAL RULES AND THE SPONSOR’S TERMS OF USE AND PRIVACY POLICY. IF YOU DO NOT CHECK THE BOX INDICATING YOUR AGREEMENT TO THE ABOVE, YOU WILL NOT BE ENTERED IN THE SWEEPSTAKES AND CANNOT WIN ANY PRIZE(S). During the entry process, you may be asked to consent to receive promotional emails and reminder emails from Sponsor. Consenting to receive promotional emails and reminder emails is optional and does not have to be agreed upon in order to be eligible to participate in the Sweepstakes and does not improve your chances of winning. In the event you do consent to receive these emails, the use of such emails shall be subject to the privacy policy of Sponsor, and you may opt out of receiving these emails at any time. 

Limit of one (1) entry per person per day regardless of the number of email addresses or accounts a person may have or if more than one person uses an email address or account. A “day” is defined as starting at 12:00 AM ET and ending at 11:50 PM ET except for the first day of the Entry Period (9/1/23) which will begin at 12:00 PM (noon) ET. Multiple entries and/or mass entry attempts will result in disqualification of all entries by such a person. Entries must be manually key-stroked by the entrant; use of automated entry devices or programs, or entries by third parties are prohibited. Entries that do not conform to or that violate these Official Rules or are submitted in any manner other than states in these Official Rules will be disqualified. Proof of submission of entry does not constitute proof of receipt of the same. By entering this Sweepstakes, entrants agree to these Official Rules and the decisions of the Administrator and Sponsor, which are binding and final in all matters relating to this Sweepstakes.

RANDOM DRAWING/SELECTION OF WINNER/ODDS: Potential winners (each a “Winner”, collectively the “Winners”) will be selected from among all eligible entries received in a random drawing conducted by the Administrator at its offices in Walnut Creek, CA, USA. The drawing will take place on or about September 15, 2023. The drawing will be conducted by the Administrator, whose decisions are final and binding on all matters related to the Sweepstakes. Odds of winning depend on the total number of eligible entries received during the Entry Period. 

PRIZES/APPROXIMATE RETAIL VALUES: 

There will be three (3) Winners in the Sweepstakes. Each Winner (also referred to herein as the “First Winner”, “Second Winner” or “Third Winner”) will receive one (1) of the prizes described below chosen by the Sponsor in its sole discretion. Each Prize is for the respective winner. 

GRAND PRIZE #1: 

The approximate retail value (“ARV”) of Grand Prize #1: $799 USD, which includes all Taxes and Fees. If the actual value of the Grand Prize #1 is less than the stated ARV, the difference will not be awarded. Content of engraving subject to approval of Administrator. 

GRAND PRIZE #2: The approximate retail value (“ARV”) of Grand Prize #2: $312 USD, which includes all Taxes and Fees. If the actual value of the Grand Prize #2 is less than the stated ARV, the difference will not be awarded. Selection of coffees in our package may vary based on seasonal availability. We may substitute any coffee with another of equal or greater value without prior notice. Packaging may vary from pictures shown.

GRAND PRIZE #3: The approximate retail value (“ARV”) of Grand Prize #3: $120 USD, which includes all Taxes and Fees. If the actual value of the Grand Prize #3 is less than the stated ARV, the difference will not be awarded. 

WINNER NOTIFICATION: Potential Winners will be notified by email on or about September 15, 2023 and will be required to complete, sign and return within three (3) business days of date of notification an Affidavit of Eligibility, Liability Release and Indemnification, a Publicity Release where allowed by law, as well as other documents that Sponsor may require collectively, “Prize Claim Documents”). Failure to respond to the initial notification within three (3) business days after notification, return of email notification as undeliverable after two (2) attempts, or failure to return the completed and signed Prize Claim Documents within the indicated time period will results in disqualification, prize forfeiture and selection of an alternate potential Winner from among all remaining eligible entries received (time permitting). 

In the event of any dispute concerning the identity of any entrant, the entry will be deemed submitted by the natural person who is the Authorized Account Holder of the email address reflected in the online account registration. For purposes of these Official Rules, “Authorized account holder” is defined as the natural person who is assigned to an email address by an Internet access provider, online service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning email addresses for the domain associates with the submitted email address. 

DISPUTES. To the fullest extent permitted by law, entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes or the awarding of the Prize shall be resolved individually, without resort to any form of class action; (2) any and all claims, judgements and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, but in no event attorney’s fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplies or otherwise increased. 

PRIVACY POLICY. Personal information provided in conjunction with a Sweepstakes entry is subject to Sponsor’s privacy policy.
